Waste Clearance Croydon Terms and Conditions

These Terms and Conditions set out the basis on which Waste Clearance Croydon provides waste removal, rubbish collection, and related clearance services to domestic and commercial customers. By booking or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings given below:

Customer means any individual, business, company, organisation, or other entity that requests, books, or receives services from Waste Clearance Croydon.

Services means any waste clearance, rubbish removal, bulky waste collection, loading, transport, recycling, or related work provided by Waste Clearance Croydon.

Waste means any items, materials, goods, rubbish, or refuse presented by the Customer for collection, removal, recycling, or disposal.

Quote means a price estimate provided by Waste Clearance Croydon to the Customer for the provision of Services, which may be given by phone, email, online form, or in person.

2. Scope of Services

Waste Clearance Croydon provides on-demand waste collection and clearance services within its operational area, including household rubbish removal, garden waste clearance, office and commercial waste removal, bulky item collection, and other non-hazardous waste services. The precise scope of each service will be confirmed at the time of booking and is based on the description of the Waste supplied by the Customer.

We reserve the right to refuse to collect certain items, including but not limited to hazardous, toxic, medical, clinical, or specialist regulated waste, or any item which we reasonably consider unsafe, unlawful, or inappropriate to handle or transport.

3. Booking Process

3.1 Bookings can be made by telephone, email, or via our online enquiry or booking systems, where available. When placing a booking, the Customer must provide accurate and complete information about the type, volume, and location of the Waste, as well as any access issues or special requirements.

3.2 Any Quote we provide before attending the Customer's premises is based on the information supplied at the time of the enquiry. The final price may be adjusted if, on arrival, the Waste differs in type or quantity from that described, or if there are access or safety issues not previously disclosed.

3.3 A booking is not deemed confirmed until we have acknowledged acceptance, either verbally or in writing, and provided a scheduled collection date or time window. We reserve the right to decline any booking at our discretion.

3.4 The Customer warrants that they are the owner of the Waste or are authorised by the owner to arrange for its removal and disposal, and that the Waste does not include any prohibited materials.

4. Access and Customer Responsibilities

4.1 The Customer must ensure that our staff have safe and reasonable access to the Waste at the agreed collection time. This includes providing clear directions, arranging for keys, codes, or permits where necessary, and ensuring that any parking restrictions are addressed.

4.2 The Customer is responsible for securing any permissions or permits required for us to park or load in restricted areas. Any parking fines or similar charges arising from inadequate permissions or information may be charged to the Customer.

4.3 The Customer must ensure that the Waste is clearly identified, separated from items not to be removed, and presented in a safe manner. We are not responsible for removing items that are not clearly designated as Waste, and we accept no liability for allegations of removal of items that were not clearly identified for collection.

4.4 If access is unsafe, blocked, or significantly more difficult than reasonably anticipated, we may refuse to carry out the Services, charge a wasted journey fee, or agree an additional charge for any extra time or labour required.

5. Pricing and Payment

5.1 Prices are typically based on the volume, weight, and type of Waste to be removed, as well as labour time, access conditions, and any additional services requested. Our pricing structure is explained to the Customer at the time of booking or upon arrival during the pre-collection assessment.

5.2 All prices are quoted in pounds sterling and, unless stated otherwise, are inclusive of any applicable UK VAT or similar taxes. If VAT applies, this will be clearly stated on any invoice or receipt.

5.3 Payment is due in full on completion of the Services, unless other arrangements have been agreed in writing in advance. We may accept payment by cash, debit or credit card, bank transfer, or other methods we may introduce from time to time.

5.4 For commercial Customers or account holders, payment terms will be set out separately. Where credit terms are granted, invoices must be paid in full within the specified period. We reserve the right to charge interest on overdue sums at the statutory rate and to recover reasonable costs of debt collection.

5.5 We are entitled to withhold or cease Services if payment has not been made in accordance with these Terms and Conditions or if we reasonably believe that the Customer may be unable or unwilling to pay for the Services.

6. Cancellations, Amendments and Waiting Time

6.1 The Customer may cancel or amend a booking by giving us reasonable notice. We ask for at least 24 hours notice before the scheduled collection time. Cancellations or amendments made with less than 24 hours notice may incur a cancellation charge or administrative fee to cover our costs.

6.2 If we arrive at the agreed time and are unable to carry out the Services due to lack of access, absence of an authorised person, or other issues within the Customer's control, we may charge a call-out or wasted journey fee.

6.3 If we are delayed due to circumstances beyond our reasonable control, including traffic, accidents, severe weather, vehicle breakdown, or other force majeure events, we will contact the Customer as soon as practicable to arrange an alternative time or date. We will not be liable for any indirect loss resulting from such delays.

6.4 Where additional waiting time is caused by the Customer, we reserve the right to charge an additional fee based on our standard hourly labour rates.

7. Waste Handling and Regulations

7.1 Waste Clearance Croydon operates in accordance with relevant UK waste management legislation and regulations, including duty of care obligations for the handling, transport, and disposal of controlled waste.

7.2 We will transport Waste only to licensed facilities such as authorised waste transfer stations, recycling facilities, or disposal sites. We aim to maximise recycling and responsible disposal in line with environmental best practice, but we do not guarantee any particular recycling rate for a specific collection.

7.3 The Customer must not present for collection any hazardous or prohibited materials, including but not limited to asbestos, chemicals, solvents, oils, fuels, gas bottles, clinical or medical waste, radioactive materials, or any other substances classified as hazardous under UK law, unless we have explicitly agreed in writing to handle such materials and hold the necessary licences.

7.4 The Customer is responsible for any breach of waste regulations arising from inaccurate description of the Waste, concealment of hazardous materials, or presentation of items that are unlawful to handle or transport. In such cases, we may refuse the collection, charge additional fees for safe handling, or notify the relevant authorities.

7.5 Title to the Waste transfers to Waste Clearance Croydon once it is loaded onto our vehicle, except in cases where the Waste has been misdescribed or is later found to be hazardous or unlawful to possess, in which case title shall be deemed never to have transferred.

8. Customer Warranties

8.1 The Customer warrants that:

a. They have full authority to arrange removal of the Waste.

b. The Waste is accurately described and does not include any prohibited or hazardous items not disclosed at the time of booking.

c. The premises are safe for our staff to enter and work in, and all necessary health and safety information has been provided.

d. Access routes, floors, stairs, and other areas used by our staff and vehicles are suitable and can bear the necessary loads without damage, save for fair wear and tear.

9. Liability and Limitations

9.1 We will exercise reasonable care and skill in providing the Services. However, we shall not be liable for any indirect or consequential losses, including loss of profit, loss of business, or loss of opportunity, arising out of or in connection with our Services or these Terms and Conditions.

9.2 Our liability for direct loss or damage to property arising from our negligence shall be limited to the reasonable cost of repair or replacement, subject to an overall cap equal to the total fees paid or payable by the Customer for the specific service giving rise to the claim.

9.3 We are not liable for any damage to items left within, behind, or attached to Waste that the Customer has asked us to remove. The Customer must ensure that no personal or valuable items are contained within items designated for disposal.

9.4 We are not responsible for any damage caused to driveways, access roads, manholes, underground services, or similar structures where we have been directed by the Customer to drive or park on them, and where such areas may not be suitable for heavy vehicles. The Customer accepts full responsibility in such circumstances.

9.5 Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded under applicable law.

10. Insurance

10.1 Waste Clearance Croydon maintains appropriate public liability and employer's liability insurance for the nature of our Services. Evidence of insurance can be provided upon reasonable request.

10.2 Insurance cover is subject to the terms, conditions, and exclusions of the relevant policies. Our liability to the Customer will not exceed the level of cover provided by our insurers where such policies apply.

11. Complaints and Disputes

11.1 If the Customer is dissatisfied with any aspect of our Services, they should notify us as soon as possible, and in any event within 7 days of completion of the relevant Services. We will review the complaint and, where appropriate, investigate and respond within a reasonable period.

11.2 We may, at our discretion, offer to reperform part of the Services, provide a partial refund, or take other remedial action where we consider that we have failed to meet reasonable standards of service. Any such remedy will be full and final settlement of the relevant complaint, unless otherwise agreed in writing.

12. Data Protection and Privacy

12.1 We collect and process personal data such as names, contact details, service addresses, and payment information in order to manage bookings, deliver Services, and administer our business.

12.2 We will handle personal data in accordance with applicable UK data protection laws. We take reasonable steps to keep such data secure and to use it only for legitimate business purposes, such as confirming bookings, issuing invoices, and addressing customer queries.

12.3 By using our Services, the Customer consents to the collection and use of their personal data for these purposes. Customers may contact us to request access to, correction of, or deletion of their personal information, subject to legal and regulatory requirements.

13. Variations to Terms

13.1 Waste Clearance Croydon reserves the right to update or modify these Terms and Conditions from time to time. Any changes will take effect when published or otherwise communicated, and will apply to bookings made after the date of such changes.

13.2 The Terms and Conditions in force at the time of the Customer's booking will apply to that booking, unless otherwise agreed in writing.

14. Governing Law and Jurisdiction

14.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services provided, shall be governed by and construed in accordance with the laws of England and Wales.

14.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter, save that we retain the right to bring proceedings against the Customer in any other court of competent jurisdiction where necessary to protect our rights.

15. General Provisions

15.1 If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable, such provision shall be deemed deleted to the extent required, but the remaining provisions shall continue in full force and effect.

15.2 No failure or delay by us in exercising any right or remedy shall constitute a waiver of that or any other right or remedy, nor shall it prevent or restrict any further exercise of that or any other right or remedy.

15.3 The Customer may not assign or transfer any of their rights or obligations under these Terms and Conditions without our prior written consent. We may assign or subcontract all or part of our rights and obligations, provided that this does not materially affect the level of service provided to the Customer.

15.4 These Terms and Conditions constitute the entire agreement between Waste Clearance Croydon and the Customer in relation to the Services, and supersede any prior understandings, statements, or representations, whether oral or written, relating to the same subject matter.
